The May Report: 6/11/2011: Part II of II: Yes, I’m sending Part II first since I still have to rewrite the Briefly noted section: This was ready at about 7pm last night when I got an important call at 7:17pm that added key info. and then just before 9:30pm — kaboom, the document for the report disappeared on me: I can see clearly now: “Lets get funky. Lets announce everything. Lets be WILDLY positive in our forecasts,” he told his Ha-Lo colleagues, even as that business was falling apart. “if we get wacked on the ride down- who gives a sh*t. Is it going to worse than today? is our market cap going to fall to 200N, 100M who the f**k cares.” — so wrote Eric P. Lefkofsky years ago and this email was revealed in the Jan. 2007 Barrons article but the media is just now catching on; I now realize how big of a mistake I’ve made since I knew this stuff & even made references to it but I was taken in by the idea that Brad and Eric had cleaned up their act and Lightbank funding local firms when others were not doing so helped draw me in; but now I’ll go out on a limb with these predictions: The IPO will be pulled in a month, the valuation will wilt to $2B from $20B; Brad and Eric will be shown the door at ChicagoBooth and so will Professor Steve Kaplan; Rahm and Quinn will disassociate themselves; Andrew Mason will leave Groupon soon, realizing he does not want another Divine or marchFIRST on his head and at 30 he’s more mature than Eric is at 41; and I wrote this myself since mama’s boy Steve L. is vacationing in Florida

Hi Ron-
I saw your report mentioning the Sync yesterday and I thought I would update the community on a few of the partners that have moved on to new space. My company Mix Media Solutions as well as MotoMedia have partnered up in an office together that is 6,000 square feet. We had our Grand Opening party last week with about 85 people in attendance. We are very happy with the move, as well as have plans to host upcoming networking events. The best part about our new space is we have a sizable open area for events to be held, which we will keep you and the community updated about.
Have a great weekend,
Jess

Bob Geras: Three corrections to what Ron wrote about the Driehaus affair — sounds like cloak and dagger to me
Subject: Three corrections.

From: bob@vcbob.com
To: RONALDMAY@aol.com
Hi Ron,
As much of a shock as this may be to you, there were at least several errors of fact in your latest report relating to the current and previous Save Abandoned Babies Texas Hold’em Poker Party Auction and some other comments.
1) The two tickets to Richard Driehaus’ Annual Birthday Party in Lake Geneva were generously donated by Richard to the Save Abandoned Baby Foundation, both in 2008 and this year, for the specific purpose of being auctioned by the Foundation with the proceeds of the sale going to benefit the charity. We never auctioned our personal invitations to the party, never have, and are certainly not doing so this year. We would never do such a thing. Richard’s birthday is on the same day as Dawn’s and he’s been a good friend of mine for over 45 years. We’ve enjoyed going to his fantastic Lake Geneva Summer party every year for the past ten years.
2) My sweetheart Dawn is a truly remarkable person. She is the love of my life, is my best friend and the best thing that ever happened to me. And yes, I did call my sister the night I met her (in 1975) and told Sandy that “I just met the girl I’m going to marry”, and I did. But, even though she looks decades younger than her age, she’s actually a “mere” 9 years younger than I am.
3) Nik was not stressed out by winning the bid for two tickets to The Party in ’08. Actually, he and his date really had a great time at the event. It is truly a fantastic experience. Like no other party you could ever imagine. We already have a $3,000 bid for this year’s pair of tickets and you’re welcome to join the bidding if you’d like to attend. We may even provide a ride for you and your guest if you’re lucky enough to have the winning bid.

“Bob, what on earth are you saying? The May Report never makes mistakes.
”
Fair enough, Ron. OK, I’ll agree that much, if not all, of the misinformation that is contained in your Report, are likely not “mistakes” but instead are deliberate exaggerations, distortions and jabs to titillate, cause controversy, and are attempts to bait people and elicit a response (as you privately admitted to me during one of your “honest” moments some years back when I visited you in the hospital !).
I guess it works ![]()
Best regards,
Bob

Bob,
I just saw your note after I sent Part III or I would have included it.
Bob, what on earth are you saying? The May Report never makes mistakes.
It never dawned on me, no pun intended, that there would some kind of high society faux pas if you took your tickets and auctioned them off. But now that you mention it, I can see how that might be awkward in terms of social protocol. I should have thought of that given that we just went through the “I’ve got this thing and it’s f****** golden” trial of Blago — twice now.
But Bob, you don’t have to throw Nik a lifeline. I know he had a good time and I know it was the time of his life, but three years ago, his wallet was not as full and there is no shame in that.
And Bob, I know how old Dawn is. But Bob I have some — not many — manners which is why I did not write her age, especially since your age is so well known. And yes, Dawn does not look her age at all. Bob, can’t you and I have our relationship and Dawn and I have our relationship without you having to be the middleman?
Finally, I do plan to attend the charity on the 18th as an observer and may need a ride for that, but Bob, I should have some advanced notice on any of my good friends who will be there like Al or Terry.
Your buddy,
Ron

To: melanie_adcock@msn.com
From: info@mediamatters.org
Dear Melanie,
This week, we got the good news that Orbitz has responded to the concerns of its customers and agreed to uphold its values. Thanks to your efforts, Orbitz has agreed to undergo a review process. They’re going to review the examples we gave them of slurs against the LGBT community and environmental misinformation to ensure that how they distribute their ad dollars no longer conflicts with their stated standards of responsibility.
Orbitz is setting an example by doing the right thing here — and we need to make sure other advertisers get the message.
Tell Fox News advertisers it’s time to Drop Fox.
Every day, the advertisers who sponsor Fox News programming give financial support to a divisive and deliberately dishonest political operation. Fox’s climate science misinformation, race-baiting, anti-LGBT attacks and smears against the Latino community are irresponsible and unacceptable for any self-described news network. Advertisers need to know that their dollars are supporting Fox News’ campaign of deception and we need your help in informing them about the consequences of supporting Fox.
Tell Fox News advertisers it’s time to Drop Fox.
Moving forward, we’ll be reaching out to other Fox advertisers to let them know why they shouldn’t sponsor Fox News. The most important thing they can hear is that there’s a strong coalition of organizations and individuals coming together in this essential education effort.
Thanks again for your support — none of this can happen without your help.

Would love to go but I will be in Orlando at the InfoComm show. Not sure what happened but this show used to take place the first week in May. The show is a lot of fun. Tons of giveaways…its like going to disneyland at holloween. I am happy to discuss some of the industry items which you might find interesting. This can help you set up useful interviews. FYI, Al Gore is often on hand because of his cable channel Current. Then, of course, there is always the Brian Roberts (comcast president) press conference. I do encourage you to attend and behave as a traditional news person (sans the “schtick”). This is a serious trade show for an industry worth 10s of billions. It is not something put together by the ITA. It has been a number of years since it was in Chicago. Hopefully they find it to be successful and will come back. Good money for the city.

Hi, Ron,
I wanted to follow up on the email my colleague Ashley Dennison sent about the 2011 Cable Show taking place on June 14-16 at McCormick Place.
If you’re interested in attending, media registration for the show is available at 2011.thecableshow.com/Media/MediaRegistration. I would also be happy to coordinate an interview with a rep from NCTA if you’re interested in learning more about The Cable Show or writing a preview piece.
Thanks!
Adina

AMERICAN SOCIETY OF SAFETY ENGINEERS’ UNVEIL DRAFT LEGISLATION AIMED AT CHANGING FEDERAL LAW TO IMPROVE WORKPLACE SAFETY & HEALTH AT 100TH ANNIVERSARY JUNE 12-15 CHICAGO CONFERENCE & EXP0
CHICAGO, IL (June 10, 2011) — The 100-year-old American Society of Safety Engineers (ASSE) today sent key U.S. Senate and House of Representative leaders draft legislation to address needed changes in the federal law to help improve U.S. oversight of workplace safety and health. The bill ASSE submitted is titled Enhancing Occupational Safety and Health Protections in the 100th Year Act of 2011 and is a bill to improve compliance with occupational safety and health laws and better encourage employer responsibility for worker safety and health.
“While the direct responsibility for saving lives and preventing injuries and illnesses in this nation’s workplaces rests with employers, we can all do a better job of helping them and encouraging them to meet that responsibility,” said ASSE President Darryl C. Hill, PhD, CSP, in letters to Chairman and Ranking Members of the Senate Committee on Health, Education, Labor and Pensions and House Committee on Education and Workforce.
“For the past 100 years ASSE’s occupational safety, health and environmental members have worked day and night in all industries to prevent workplace injuries and illnesses. And, they have seen results, but at the same time note that more needs to and can be done,” Hill said.
Hill noted that this is an important time for the profession and ASSE. “That’s why, on this our 100th Anniversary, ASSE offers the enclosed draft legislation to build on what we have learned is missing in the way this nation oversees workplace safety and health. After 40 years of the OSH Act and other decisions made following its passage in 1970, workers should be able to rely on a thoughtful reexamination of that Act’s effectiveness, which we hope our draft legislation encourages.”
In his letters, Hill notes that the changes to the OSH Act ASSE offers are structural in nature, meant to help OSHA work better, be more effective in its outreach, and keep up with rapidly advancing knowledge about how to protect workers and workplaces.
“The same is true of our effort to relocate the National Institute of Occupational Safety and Health (NIOSH) within the Department of Health and Human Services,” Hill said. “Most of the ideas are those ASSE has championed over the years, and some are ideas we backed in the occupational safety and health reform debate over the last several years. You will find ideas offered by both Republicans and Democrats. If not on this 100th anniversary, which we also consider the beginning of a modern commitment to safe and healthy workplaces, when will be a better time to build on what we know can work to improve how our nation oversees occupational safety and health protections in our workplaces?”
ASSE’s bill contains provisions on coverage of public sector employees; updating permissible exposure limits; advancing a risk-based regulatory approach; encouraging collaborative rulemaking; enhanced definition of competent person; encouraging OSHA consideration of voluntary consensus standards; enabling OSHA to update standards with voluntary consensus standards; relocation of NIOSH within the Department of Health and Human Services; increased criminal penalties for those responsible for safety culture in an organization; encouraging employer risk assessment through third part consultations; encouraging risk assessment through safety and health audit privilege ; codification of the Voluntary Protection Program (VPP); and, expanded access to VPP for small businesses.
“Efforts of employers and our members, OSHA’s regulatory oversight, and the research and support for education that NIOSH directs have been highly successful. But no one believes workers are safe enough,” Hill said. “No one believes that we cannot do better. Let’s do better.”
Founded in 1911, the 100-year-old Des Plaines, IL-based ASSE is the oldest safety society and has nearly 34,000 occupational safety, health and environmental professional members who lead, manage, supervise, research and consult on safety, health, transportation and environmental issues in all industries, government, labor, health care and education.
