* This report would have been out by 3pm today, but I got a call from a person who helps biotech start-ups in Kansas!
That person wants to see that “son of a bitch Tom Thornton fired” and stated that “Tom Thornton is a liar.”
He is also very political, manipulative and all the things we know. What he does is control $581MM and what he does not do is help small start-ups.
Tom has a lot of political connections in Kansas and the operation he runs is anything but transparent, my source says.
Tom controls a $30MM venture capital fund and he has brought in a lot of companies that have no connection to Kansas, I was told. One of them is Quintiles (do I have the spelling on that right?) which is a big CRO.
The conversation covered a lot of ground including an ethics complaint against Tom from a woman who worked for the KBA.
The Kansas Bioscience Authority is not a 501(c)(3) or any other kind of 501 organization. It is a state created agency of sorts.
You would think that what Tom makes is a simple and easy to answer question but it did not turn out that way. It took quite a bit of work on the part of the state legislature to get the information which was published in yesterday’s article in this report.
It turns out that when the state of Kansas is broke, Tom Thornton has managed to give himself and his employees including his wife Lindsay a bonus!
Tom’s base salary is $265K and he has a $100K bonus. His wife has a salary of $107K I believe and a bonus of $5K. That gives the two of them a combined salary of $470K not counting Tom’s car allowance and his expense account. That info. took a lot of work to get out of Tom. Again, there are no 990 filings here. But why would an organization established by the state of Kansas have to be prodded to give up basic operating info.? Well, that is because you have Tom Thornton running it.
Tom has brought in his buddies as we know and one of them is Dr. Terry Osborn. But my info. is that Terry is living in Chicago and has not moved to Kansas but that is NOT confirmed yet. BTW, Osborn is being paid $150K — a nice gig if you can get it — while at the same time, he holds a couple of positions for which he is paid in the private sector but that is also NOT confirmed.

It is clear from this document that the power of the board is effectively unchallenged. So, the question becomes: Who is on the board and how do they get there?

Statute 74-99b04: Kansas bioscience authority; establishment; headquarters; membership, terms of office; vacancies; confirmation; compensation; meetings; powers; quorum; dissolution. (a) There is hereby established a body politic and corporate, with corporate succession, to be known as the Kansas bioscience authority. The authority shall be an independent instrumentality of the state. Its exercise of the rights, powers and privileges conferred by this act shall be deemed and held to be the performance of an essential governmental function.
(b) In order to accelerate any and all synergy and opportunities for the growth of the authority, the authority shall be headquartered and establish its principal operation in the county in the state with the highest number of bioscience employees associated with bioscience companies as of the effective date of this act. The exact location of the authority’s headquarters and principal operations in such county shall be at the discretion of the authority’s board.
(c) The authority shall be governed by an eleven-member board. One member of the board shall be an agricultural expert who is recognized for outstanding knowledge and leadership in the field of bioscience. Eight of the members of the board shall be representatives of the general public who are recognized for outstanding knowledge and leadership in the fields of finance, business, bioscience research, plant biotechnology, basic research, health care, legal affairs, bioscience manufacturing or product commercialization, education or government. Of the nine voting members, five must be residents of the state. The other two members of the board shall be nonvoting members with research expertise representing state universities and shall be appointed by the Kansas board of regents. Nonvoting members shall serve at the pleasure of the board of regents.
(d) Of the nine voting members who will be appointed to the authority’s first board, two shall be appointed by the governor for a term of office of four years, two shall be appointed by the speaker of the house of representatives, one of which shall be the agricultural expert as authorized in subsection (c), for a term of office of three years, two shall be appointed by the president of the senate for a term of office of three years, one shall be appointed by the minority leader of the house of representatives for a term of office of two years, one shall be appointed by the minority leader of the senate for a term of office of two years, and one shall be appointed by the Kansas technology enterprise corporation for a term of office of one year. Members of the first board shall be appointed by August 1, 2004. No more than three voting members shall be appointed from any one congressional district. All voting members of the board shall be subject to senate confirmation as provided in K.S.A. 75-4315b and amendments thereto. Any member of the board whose nomination is subject to confirmation during a regular session of the legislature shall be deemed terminated when the senate rejects the nomination. No such termination shall affect the validity of any action taken by such member of the board before such termination.
(e) Terms of voting members appointed pursuant to this section shall expire on March 15.
(f) After the expiration of the terms of the authority’s first board, or whenever a vacancy occurs or is announced regarding a voting member or members of the board, such voting member or members shall be appointed as described in subsections (c) and (d), except that such members shall be appointed for terms of four years each. In the event of a vacancy the appointment shall be for the remainder of the unexpired portion of the term. Each member of the board shall hold office for the term of appointment and until a successor has been confirmed. Any member of the board is eligible for reappointment, but members of the board shall not be eligible to serve more than three consecutive four-year terms.
(g) Except for appointments of nonvoting members, each appointment shall be forwarded to the senate for confirmation as provided in K.S.A. 75-4315b and amendments thereto. Except as provided by K.S.A. 2009 Supp. 46-2601 and amendments thereto, no person appointed to the board shall exercise any power, duty or function as a member of the board until confirmed by the senate. In case of a vacancy when the senate is not in session, the appointing entity may make a temporary appointment to the board until the next meeting of the senate. Any person who is temporarily appointed by the appointing entity to the board shall have all of the powers, duties and functions as a member of the board during such temporary appointment.
(h) The board annually shall elect a voting member as chairperson and at least one other as vice-chairperson. The board also shall elect a secretary and treasurer for terms to be determined by the board. The board may elect the same person to serve as both secretary and treasurer. The board shall establish an executive committee, nominating committee and other standing or special committees, and prescribe their duties and powers. Any executive committee of the board may exercise all such powers and duties of the board as the board may delegate.
(i) Members of the board are entitled to compensation and expenses as provided in K.S.A. 75-3223, and amendments thereto. Members of the board attending board meetings or subcommittee meetings authorized by the board, shall be paid mileage and all other applicable expenses, provided such expenses are consistent with policies established from time-to-time by the board and as required by subsection (k).
(j) No part of the funds of the authority shall inure to the benefit of, or be distributed to, its employees, officers or members of the board, except that the authority may make reasonable payments for expenses incurred on its behalf relating to any of its lawful purposes and the authority shall be authorized and empowered to pay reasonable compensation for services rendered to or for its benefit relating to any of its lawful purposes, including to pay its employees reasonable compensation.
(k) Any member of the board other than a nonvoting member may be removed by an affirmative vote by six members of the board for malfeasance or misfeasance in office, regularly failing to attend meetings, or for any cause which renders the member incapable of or unfit to discharge the duties of director.
(l) The board shall meet at least four times per year and at such other times as it deems appropriate, or upon call by the president or the chairperson, or upon written request of a majority of the directors of the board. The board may adopt, repeal and amend such rules, procedures and bylaws, not contrary to law or inconsistent with this act, as it deems expedient for its own governance and for the governance and management of the authority. A majority of the total voting membership of the board shall constitute a quorum for meetings. The board may act by a majority of those at any meeting where a quorum is present, except upon such issues as the board may determine shall require a vote of six members of the board for approval. The board shall meet for the initial meeting upon call by the member of the board appointed by the Kansas technology enterprise corporation, who shall act as temporary chairperson until officers of the board are elected pursuant to subsection (i).
(m) The board shall appoint a president who shall serve at the pleasure of the board. The president shall serve as the chief executive officer of the authority. The president’s salary shall be set by the board. The board may negotiate and enter into an employment agreement with the individual selected as president of the authority, which may provide for compensation allowances, benefits and expenses as may be included in such agreement. The president shall direct and supervise administrative affairs and the general management of the authority.
(n) The board may provide supplemental benefits to the president and other authority employees designated by the board in addition to the benefits provided under this act.
(o) The authority shall continue until terminated by law, except that no such law shall take effect so long as the authority has debts or obligations outstanding, unless adequate provision has been made for the payment or retirement of such debts or obligations. Upon any such dissolution of the authority, all property, funds and assets thereof shall be vested in the state, bioscience research institutions or both as designated by the board, or any other public institute or private enterprise engaged in the business of bioscience, or any combination thereof, as designated by the board and approved by act of the legislature.

May again. The new governor of Kansas Sam Brownback has not really taken a stance on the KBA so far. He just started in office. Prior to this, he was U. S. Senator from Kansas. I doubt that the governor or any other state official in KS has the power to get rid of Tom.
* Word is that Juno Wallet has pulled this bait-and-switch sponsorship ploy before with other groups – even if unintentionally, it indicates lack of ethics and administrative follow-through. One of the other groups they harmed stopped them dead in their tracks – just in the nick of time, I am being told. It wasn’t pretty. The group got what was committed, but it took some work.
* The entire staff of the Entrepreneurial Center of the Chicago Urban League has been fired slowly but systematically over an 18 month period I am hearing. More to come on this.

(Chicago) – The Illinois Science Council, a nonprofit organization supporting appreciation of science, technology, engineering and math, asked Chicago-area bakeries and restaurants to offer specials on Monday, March 14 to acknowledge the importance of pi in our lives by celebrating with tasty pie specials.
Pi, if you’ve forgotten the geometry lesson, is the ratio of a circle’s circumference to its diameter. Pi is abbreviated to 3.14, but continues indefinitely. To date, it has been calculated by computer to over 1.2 trillion digits. Competitions exist for reciting the most digits by memory. As the world’s most famous mathematical constant, Pi is important to many formulas used in mathematics, science, engineering and statistics. Monday also happens to be Albert Einstein’s birthday!

THIS IS NOT THE ‘DON’T BUY’ GAS FOR ONE DAY, BUT IT WILL SHOW YOU HOW WE CAN GET GAS BACK DOWN TO $1.30 PER GALLON.
This was sent by a retired Coca Cola executive. It came from one of his engineer buddies who retired from Halliburton. If you are tired of the gas prices going up AND they will continue to rise this summer, take time to read this please.

I hear we are going to hit close to $ 4.00 a gallon by next summer and it might go higher!! Want gasoline prices to come down?
We need to take some intelligent, united action.
The oil companies just laughed at that because they knew we wouldn’t continue to “hurt” ourselves by refusing to buy gas .
It was more of an inconvenience to us than it was a problem for them.
BUT, whoever thought of this idea, has come up with a plan that can Really work. Please read on and join with us!
By now you’re probably thinking gasoline priced at about $2.00 is super cheap. Me too! It is currently $3.15 at the Hess I go to.
Now that the oil companies and the OPEC nations have conditioned us to think that the cost of a gallon of gas is CHEAP at $1.50 – $1.75, we need to take aggressive action to teach them that BUYERS control the marketplace..not sellers.
With the price of gasoline going up more each day, we consumers need to take action.
The only way we are going to see the price of gas come down is if we hit someone in the pocketbook by not purchasing their gas! And, we can do that WITHOUT hurting ourselves.
How? Since we all rely on our cars, we can’t just stop buying gas.
But we CAN have an impact on gas prices if we all act together to force a price war..
Here’s the idea: For the rest of this year, DON’T purchase ANY gasoline from the two biggest companies (which now are one), EXXON and MOBIL.
If they are not selling any gas, they will be inclined to reduce their prices. If they reduce their prices, the other companies will have to follow suit.
But to have an impact, we need to reach literally millions of Exxon and Mobil gas buyers. It’s really simple to do! Now, don’t wimp out on me at this point…keep reading and I’ll explain how simple it is to reach millions of people!!
I am sending this note to 30 people. If each of us send it to at least ten more (30 x 10 = 300) … and those 300 send it to at least ten more (300 x 10 = 3,000)…. and so on, by the time the message reaches the sixth group of people, we will have reached over THREE MILLION consumers .
If those three million get excited and pass this on to ten friends each, then 30 million people will have been contacted!
If it goes one level further, you guessed it….. THREE HUNDRED MILLION PEOPLE!!!
Again, all you have to do is send this to 10 people. That’s all!
(If you don’t understand how we can reach 300 million and all you have to do is send this to 10 people…. Well, let’s face it, you just aren’t a mathematician. But I am . so trust me on this one.
How long would all that take? If each of us sends this e-mail out to ten more people within one day of receipt, all 300 MILLION people could conceivably be contacted within the next 8 days!
I’ll bet you didn’t think you and I had that much potential, did you! Acting together we can make a difference.
If this makes sense to you, please pass this message on. I suggest that we not buy from EXXON/MOBIL UNTIL THEY LOWER THEIR PRICES TO THE $2.00 RANGE AND KEEP THEM DOWN. THIS CAN REALLY WORK.My Feeling is to give it a shot,Can’t Hurt or remember the old “Why Not”.

I’ve been a fan and follower of The May Report (Melanie’s strong assistance) the past six months. I found the May Report by accident when googling projects and I’m hooked! Your comments on the passion of Mike Rhodes and Green Acres hit home. I’m not a real estate broker, but due to my own business interests have showed a large finished space at 3350 N. Cicero to a few investors. My thought was both business, technology and possible indoor sports field for recreation, trying to create or duplicate a similar concept on the north side as Mike Rhodes .
What drew me to the north side was the commuting time, parking, and how many people live on the perimeter of the city, believing that a north side hub might be ideal location. I sent Mike Rhodes the attached email as I was in shock that he needed a space! What is most important is the resources continue to be available to Chicago and the think tank concept and business networking continues. Keep up the good work!

Ive been a follower of the May Report. Your concept has intrigued me from day one that I followed you. Never made it to your “shop”. There is a space at 3350 N. Cicero that is turnkey. What you don’t see is the lower basement level and the parking above. LOTs of space. Wanted to do something’ similar as yours–think tank, showroom, networking, technology center, —and then go further. My selling points were: Ciy is always a hassle to park. This space is between Edens, OHare off of Belmont. Near many major traffic centers. Please think about.

Donor Alert: Giving to Pacific Tsunami and Japanese Earthquake Victims
Be Sure Disaster Relief Charities are Legit and Equipped to Help
CHICAGO, IL – March 14, 2011 – Featured news videos and media reports detailing the enormous damage from of the devastating earthquake and resulting tsunami that hit Japan last week resulted in damage even to the Hawaii and the west coast of the U.S. has prompted many Americans to consider making donations to charities that provide relief to survivors.
The Better Business Bureau (BBB) advises potential donors to be cautious because fraudulent charities and individuals often crop up to take advantage of their sympathy for victims of natural disasters.
“Unfortunately, we’ve seen time and time again that scammers will try to take advantage of the generosity of the public after a disaster,” said Steve J. Bernas, president & CEO of the Better Business Bureau serving Chicago and Northern Illinois. “That’s why it’s so important to take your time and do your research before donating to relief efforts.”
The best way to help is to donate money to a reputable humanitarian organization with a history of providing assistance in disasters and other crisis situations.
When making a donation of any kind, the BBB encourages consumers to follow to certain guidelines, including:
Before donating, visit www.bbb.org/charity to research organizations you’re considering supporting.
Be wary of charities that are reluctant to answer reasonable questions about their operations, finances and programs.
Ask for written information about the charity’s program(s) and finances such as the charity’s latest annual report and financial statements.
Ask what the charity intends to do with any excess contributions remaining once they’ve fully funded the disaster relief activities mentioned in solicitations.
Don’t give cash. Checks or money orders should be made out to the name of the charitable organization, not to the individual collecting the donation.
Beware of fake charities that imitate the name and style of well-known organizations in an attempt to confuse donors.
Don’t give in to excessive pressure for on-the-spot donations. Be wary of any request to send a “runner” to pick up your contribution.
Be wary of any charity that is inexperienced in carrying out relief efforts but is suddenly soliciting for aid in the wake of the earthquake and tsunami. Although well intentioned, they may not be able to quickly deliver aid to those in need.
Find out if the charity is providing direct aid or raising money for other groups. Check out the ultimate recipients of the donations to ensure that the organizations are equipped to effectively provide aid.
Be wary of appeals that are long on emotion, but short on describing what the charity will do to address the needs of victims and their families.
Find out if the charity has a presence in the impacted areas. Unless the charity already has staff in the affected areas, it may be difficult to get new aid workers into the area to provide assistance. See if the charity’s website clearly describes what they can do to address immediate needs.
Don’t give your credit card number or other personal information to a telephone solicitor or in response to an e-mail solicitation.
Make sure your contribution is tax deductible: donations should be made to charitable organizations that are tax exempt under section 501(c)(3) of the Internal Revenue Code. Go to IRS Publication 78 on the IRS’ website for a current list of all organizations eligible to receive contributions deductible as charitable gifts

As far back as 2002, I recall being asked by Japanese Prefectures for planning ideas from the US to respond to a large quake and tsunami (at the GBOC trade show).
While some news organizations have been reporting the twin disasters as unforeseen. Maybe not if they read the May Report (see, below).
Many of the Prefectures seemed to realize that a vast nightmare was looming, as a result of their experience with the quakes in Kobe. The Japanese Prefecture representatives feedback to my presentations in 2002 made me realize the potential for destruction. I was not aware of the potential and I returned to the US to do some further research.
At the time, I was shocked to find that the US really did not have the kind of resources that the Prefectures sought, if anything, the US was further behind.
Unlike Japan, the US has a large enough land mass that evacuation to other parts of the country is possible in the case of a direct hit on an urban center. Most people think of California, but I also think about the New Madrid and other faults in the Midwest (as well as some active faults up here).
I would have to say that Katrina, several subsequent large earthquakes, the tsunami of 2004 have changed disaster response, but planning may still lag behind. I’ve even had to clip the original link to disaster frameworks (many of the items were reflected in some post-Katrina reports) because the link has lapsed.
I regret that we were never able to expand upon some of the disaster planning framework ideas, but I just did not see a sufficient US interest in the topic over the last decade.
You may remember the number of false web sites that popped up in 2005 after the tsunami.
One of the best things that you can do is work with your contacts in Illinois with JETRO, Sister Cities, and some of the people who have already contacted you to identify legitimate charities to which people may direct their resources to help in Japan’s recovery.

Gentlemen,
You may recall that when I went to Japan, I significantly broadened my
perspective on disaster preparedness. One of the concerns that the
Japanese Prefectures and companies mentioned was the possibility of some
devastating quakes in Japan. In light of several recent Japanese quakes, I
thought it best to discuss how individuals and businesses (anywhere) can
improve their own preparedness plans.
Last January, I worked with two teams in Chicago and New York to respond to
an Air Force Small Business Innovation Research Request proposing
comprehensive and proactive disaster preparedness frameworks. The program
was not funded.
In March of 2004, the Department of Homeland Security released released its
National Incident Management System (NIMS) Manual. Under the new program,
NIMS may be more proactive than FEMA. I have removed the proposal text from
our Air Force SBIR Application and added a few a link to NIMS.
I will be releasing the following raw article link to some New York and

I have to share your depression about the earthquake and tsunami, but with
some hope for the survivors and their future. Last October, I sent you a
link to material about disaster preparedness for major disasters. I have
updated the link, at XXX to include a
list of groups responding to the 2004 disaster (lists are USAID’s and
CNN’s). I regret the horrible circumstances under which I am compelled to
write to you again, and so soon.
Perhaps your readers can add links to your newsletter that USAID and CNN
have overlooked.
It looks as if Public Law 109-1 will be an Act discussing the relief
efforts. I think that it is a good start for the 109th Congress. Despite
some initial acrimony, I think that both parties will support this cause.
There is also an overwhelming outpouring of support from across the globe.
It will be needed. In the long run the cost will be in billions.
One downside to the disaster is that the topic has dwarfed other disaster
relief efforts in hotspots throughout the rest of the world.
May 2005 bring better news.

Yes. That was not an exagerration – at least in my dealings with a Japanese trust bank in the year 2000 when I was running Blair’s Japan office. I still have a copy of the apology letter (in Japanese of course).
9. What do you feel accounts for the difference between Japanese and Chinese views on IP? As Adlai Stevenson, Jr. told me in 1995, the Chinese consider it a crime to steal a chicken but not to steal a book.
Great question Ron. I think there are several underlying cultural differences between the Chinese and Japanese that influence this. Whereas for the Chinese, time is money and financial success is an ultimate goal, for the Japanese (very generally speaking) other issues – such as reputational standing and acceptance within the circles one lives – ranks higher. Both prize academic achievements but Chinese have a greater appetite (in my opinion) to confrontation and the use of backdoor influence to reach certain goals. The Chinese are the ultimate robber barron era capitalists; the Japanese are (in reality) much closer to the ideals of socialism in many ways (work for the common good; no one should earn too much; the group is greater than the individual).

Great question Ron. I used it to highlight the actual commercialization. The book I referred to last night – “Saying Yes to Japan” – www.sayingyestojapan.com/ speaks to some of the innovative things non-Japanese entrepeneurs (including several from Chicago) have done in Japan.

I don’t think it is inherently bad, but it means that there is a different angle than in the U.S.
14. I got the impression that even publicly owned firms in Japan are still the province of family ownership and long standing relationships. If that is true, then how is it changing to improve performance — or is it?
There is a heavy legacy of family management in Japanese companies but (again, my subjective opinion) far less than in (say) China or Indonesia. Japanese companies have cadre of Western-trained staff at mid and lower management levels whose self-identity is perhaps more closely tied with the company than in China. I don’t know what staff turnover rates are in for example Shanghai versus Tokyo but my guess is that the Chinese turnover rates are extremely high and the Japanese quite low.
15. Does Japan have a lot of university and lab supported research as we do in the U.S.?
That is another good question I do not have any hard answer for. My suspicion is that ‘yes’ they do. A friend of mine (whom I have known nearly 30 years) is in a private equity joint venture that commercializes IP from Tokyo University (the Harvard of Japan) and works with a counterpart at MIT. I will try and see if he has some data on this and get back to you.

Below are a few more detailed responses to some of the Qs you raised.

If it had been at the Japanese level of apology, a Japanese CEO would certainly apologize publicly (often at a press conference). Those apologies are sometimes scripted (e.g., the apology is down at an industry association press club, announcements are made in advance to the press, statements are written in advance and printed for the press, etc.). That said, the Japanese are not fools of course and can discern a sincere from a false apology.
All that said, the public apology is oftentimes just the most visible part. CEOs might resign (sometimes with a fallback position, sometimes not) and they may also visit some of their most important corporate relationships (regulators, government officials, key clients and key stakeholders) to apologize in person.
If I had myself advised Andrew Mason, I might have suggested for him a trip to Japan and a public apology as well as some morale building frank talk among Groupon’s Japanese staff. Perhaps he already did that (and a written apology). If he did then I think Japan (which has a huge coupon culture) could well become an important market for Groupon (if it isn’t already).

Yes. That was not an exagerration – at least in my dealings with a Japanese trust bank in the year 2000 when I was running Blair’s Japan office. I still have a copy of the apology letter (in Japanese of course).
I’ll supply you with precise details. It was in the spring of 2000. One of the largest Japanese trust banks had been a prospect for many years. We had hosted their staff, we had supplied extensive information, market intelligence, and done all the bend-over-backwards service elements that differentiated our level of care from that of our competitors. They had been convinced of our value-added after not only all of that but also verification from others that we were a legit firm, etc. So the big day came and they decided to send us the order (perhaps 600,000 shares of various U.S. stocks with commissions of about 6 cents/share (considerably more than brokers receive today in the institutional world).
The client expected that after the trades were complete (which would be approximately 3PM Chicago time/6 AM Tokyo time the next day) we would send them an excel spread sheet (of their construction) with all the details and that everything would tally. As I mentioned verbally, we checked and double-checked the tally first in Chicago and then in Tokyo (where I was) and could not seem to reconcile the spreadhseet numbers with the written backup of each trade. Every number matched except the total. It took is 4 hours (until 10 AM Tokyo time) before we discovered the rounding error. Meanwhile the client was anxious about the results and unhappy that we had kept him waiting that long (as well as that he had taken a gamble on using us and we had this ‘mistake’).
The result was as I mentioned to you: (1) a 6 month suspension of further business with the client; (2) a written apology (they sent me the form letter and I typed it up on our letter head and placed my seal on it); (3) a promise that if I ever had another error on any trade all business with them would permanently be prohibited forever; (4) visit their offices with multiple originals (addressed to different key people) as well as modest gifts of fancy cookies and apologize in person to each of those individuals (a very humiliating experience I can assure you).
This may seem extreme (and being on the receiving end at the time I certainly felt that way) but it helps to hone your instinct for errors to a razor fineness. That discipline has benefitted me a great deal in the years since.
There are a few other items I still owe you Ron. I will send those as soon as I can.

As the after-effects of the tragedy of the earthquake and tsunami in Japan continue to unfold, Keynote will continue to closely track the performance of the Internet, the most vital form of communication currently available across the country.
You can attribute the following observations to Keynote Systems for stories you are preparing for Sunday and Monday editions that include information on how the Internet has performed so far across Japan post earthquake.
Mobile and Internet monitoring firm Keynote Systems (KEYN) examined the performance of the Internet from Japan late Friday afternoon. It found very few problems at a macro level, but some leading Japanese sites struggled to stay up and available. Dave Karow, senior product manager for Internet test and monitoring at the company said, “At a macro level, the Internet did what it’s supposed to do. It didn’t even blink. Access from Tokyo to major internet properties based on the Keynote Business 40 was not impacted in any meaningful way. Additionally, access between Tokyo and regional hubs including Seoul, Singapore and Taipai, as well as San Francisco, was not impacted either.”
Karow continued, “However, on the micro scale we examined a number of popular Japanese-hosted sites, looking for performance alarms tripped during the day. What we found was that most alarms were for slow-downs rather than site failures and most were short lived — less than an hour. Interestingly, these performance alarms were spread out throughout the day rather than clustering around the time of the earthquake. A small number of alarms were for complete outages. These site outages tended to be longer, averaging 7.5 hours.”

Springfield, Illinois March 4, 2011 – Two current bills under consideration by the Illinois General Assembly are expected to generate increased revenues for the state. They would allow smoking in gaming facilities and eligible businesses that have liquor licenses. The International Premium Cigar & Pipe Retailers Association favors both proposals and today urged their passage.
House Bill 171 allows smoking in designated segregated ventilated smoking rooms in licensed gaming facilities. House Bill 1310 provides that local liquor control commissions have the power to issue smoking licenses to bars and other adult-oriented establishments that have revenues with no more than 10 percent from food sales.
“The so-called Smoke Free Illinois Act prohibited smoking in all indoor workplaces and public places including bars/taverns, restaurants, private clubs and casinos beginning January 1, 2008. These bills back off at least somewhat from that draconian, irrational position by allowing, under certain circumstances, smoking in casinos and cigar bars and other adult places. As we see it, this would be a return to reason and we support their passage,” said Chris McCalla, legislative director of the IPCPR.
McCalla noted that the Illinois Gaming Board has confirmed that passage of HB 171 “could have a positive impact on revenues” and it is generally acknowledged that re-creation of cigar bars also will generate increased revenues for the state as well as local authorities through licensing, taxes, jobs and sales taxes.
“It’s the smart thing to do,” said McCalla. “It’s good for business, good for jobs and good for the state. ”
The Federal Reserve Bank of St. Louis has declared that the current statewide smoking ban was the primary reason that its nine casinos lost $400 million in revenues in its first year. The study showed that the smoking ban was chiefly responsible for a 22 percent decline in revenues compared to recent years. It was also responsible for the improved or more stable performance of casinos in nearby states during the same period. In addition, local communities also lost over $12 million in casino tax revenues.
For those concerned about secondhand smoke, don’t be, McCalla advised. He cited the safe levels of secondhand smoke established by the U.S. Department of Labor’s Occupational Safety and Health Administration.
“There is a falsely placed prejudice regarding secondhand smoke that never should have been allowed to fester in the first place. Even OSHA has established safe levels of secondhand smoke and those levels are literally thousands of times higher than normally found in bars and restaurants that allow smoking.”

In 2009, Infotonics had thousands of square feet of vacant space. Infotonics ended 2009 with it’s third management team since the pre-opening of the facility in 2003. Politicians had hoped to create (or inspire) 5,000 jobs, but management tended to think in terms of hundreds, not thousands, at the site – yet, FTE staff was probably under 100 into 2010. That will change in 2011 both on site and in the community. Most people having trouble saying or spelling Canandaigua (try Can-an-Day-Gwa), but I think Canandaigua and Ontario County are worth putting on any group’s Economic Development map.
I worked with Infotonics’ third management group to make better use of the space with commercial tenants and to save a fund that David Gottfried had secured to help small or medium businesses. The first smart move was to bring David onto Infotonics staff.
Over the course of late 2009 and into 2010, my prospects and David’s prospects toured the facility, met with State and Federal contacts and engaged in lease negotiations. Our combined efforts to fill the space also led to David’s successful efforts to expand the fund for building improvements from $3M to $6M (for new businesses smart enough to take advantage of access to this unique facility). Infotonics had state of the art fiber optics from Axcess Ontario, superior electrical facilities (already on campus to support the existing clean room facilities) and backup capacity that would be subject to future conditioning and new power management systems.
As of 2011, only a few hundred square feet of clean room space remained and Infotonics has merged with the College of Nanoscale Science and Engineering (CNSE), – which reclaimed some of the vacant space for its own use. Plans for a new building and future expansion now replace the previous quest to move from in “the red” to in “the black.” The original notion was that commercial tenants such as a data center and manufacturing concern would help put the center into the black. The resources of the CNSE ended up being an added bonus.
What a difference a year makes. Not everyone who came to visit was part of the year’s success, but they all started the year with equal chances.
Rather than just moving past break even, Infotonics has become the Smart System Technology and Commercialization Center of Excellence (STC).
People of the City and Town of Canandaigua should be saying: “Kudos to Paul Tolley and David Gottfried on a year of hard work to move our diamond out of the rough!” They should also extend a warm welcome to Alain E. Kaloyeros.

Tech partnership drives growth
“Coming together is a beginning,” Henry Ford said. “Keeping together is progress. Working together is success.”
Recently, the former Infotonics Technology Center in Canandaigua – now called the Smart System Technology and Commercialization Center of Excellence (STC) – was integrated into the College of Nanoscale Science and Engineering (CNSE) in a partnership of two of New York’s Centers of Excellence.
This merger is a perfect example of the inter-regional economic development strategy that leverages the intellectual capabilities, physical assets and corporate network of the college to advance a public-private partnership. This acts as a catalyst for nanotechnology innovation, workforce training, business investment and job creation in Greater Rochester.
The Canandaigua center’s expertise in developing and commercializing products that interface computer chips with electro-mechanical and biological devices, when leveraged by the $7 billion CNSE enterprise, puts New York in the leadership position in the global effort to develop and bring to market next-generation smart technologies.
The opportunities are limitless. From advanced sensors that address critical national needs to intelligent devices that meet consumer demands – think smart phones, GPS, and supermarket scanners – nanotechnology-enabled smart systems are becoming ubiquitous.
What is truly exciting are the emerging applications that will address society’s most critical challenges: health care, using “lab-on-a-chip” for disease diagnosis and treatment; green technologies, fueling advances in clean energy and environmental protection; and national defense, catalyzing innovations to equip and protect our troops.
The impact is real and immediate. First, Moser Baer Technologies, the U.S. division of a $4 billion corporation based in India, announced the establishment of the world’s first pilot production facility for Organic Light Emitting Diode lighting panels at STC. The company will invest $17 million and create 60 high-tech jobs, a key step toward advancing green technologies.
Then, STC was awarded two national contracts that support over $6 million in leading-edge programs. STC will build and test smart systems, including intelligence and surveillance sensors, for the U.S. Space and Naval Warfare Systems Command.
The Electric Power Research Institute has contracted STC to design innovative wireless sensor systems to monitor the reliability and safety of technologies ranging from jet engines to power generators, while increasing efficiency and reducing cost.
New York state is a critical enabler in realizing these opportunities. Gov. Andrew Cuomo’s creative “New York Works” plan and resourceful budget proposal continue and expand strategic investments in nanotechnology.
These investments build on the strategy and support of Speaker Sheldon Silver and the Assembly, long recognized as drivers of New York’s nanotechnology ecosystem.
Nanotechnology is driving the 21st century innovation economy, and New York has what it takes to become the world’s epicenter of this economy. As such, we are united in our commitment to achieving long-term economic prosperity and business growth across our great state.
